- The California Supreme Court has granted review in a case being handled by Kurt L. Schmalz involving the physician peer review process in hospitals. In El-Attar v. Hollywood Presbyterian Medical Center, 2011 DAR 12653 (Case No. B209056, 8/19/11), a unanimous panel of the court of appeal held that in the absence of a medical staff bylaw provision to the contrary, the elected committee of the medical staff must appoint the peer review hearing panel and hearing officer and cannot delegate this task to the governing board of the hospital. On November 30, 2011, the Supreme Court granted review of the El-Attar case on this issue.
